
Environmental Noise
As entertainment industry specialists, we at tsg are aware of the increasing number of complaints being received by local authorities (EHO), regarding noise from licensed premises. On receipt of such complaints councils are, under the Environmental Protection Act 1990, obliged to investigate. As well as jeopardising licenses, complaints which are upheld can result in fines of up to £20,000, if issued Notices are not fully complied with.

Noise at Work
The Control of Noise at Work Regulations 2005, requires employers to prevent or reduce the risk to employee health and safety, from noise exposure. Where amplified music is played, it is very easy for staff to be exposed to limits in excess of those prescribed by the legislation. Although licensed premises have benefited from an extended ‘amnesty’, it now seems likely that local authorities will start to rigorously enforce this safety legislation, as they have in other industries.
To avoid injury to staff and the potential prosecution/litigation; an employer should be able to demonstrate that they have done the following: taken action to reduce noise exposure that produces risk to health and safety, provided hearing protection where needed, provided information and training to staff, carried out proper noise risk assessments.
